What if Divorced Parents Disagree about their Children Getting the Covid-19 Vaccine?

Parents often feel very strongly about how to raise their children. This is especially true when it comes to the COVID-19 vaccine. If you and your ex-spouse share custody, and cannot agree about whether to vaccinate your child, read on to learn more.

What are the Different Types of Custody in New Jersey?

There are two types of custody in New Jersey:

  • Physical Custody
    • Physical custody is awarded to the parent with whom the child will reside for more of the time. This parent will be responsible for the child more of the time and provide a home, stability, food, clothes, etc. In some situations, custody can be shared equally by both parents or guardians.
  • Legal Custody
    • When a parent has legal custody, he or she has the right to make important decisions in the child’s life. These decisions may include choices about academics, religion, medical issues, etc. A parent does not have to have physical custody to have legal custody.  One or both parents may have legal custody.

What Steps to Take if You and Your Ex-Spouse Disagree About the Vaccine

If you have sole legal custody, it is up to you whether you vaccinate your child. But, if you share legal custody, you and your spouse will have to agree. It is important to speak with your child’s pediatrician. This will ensure that you can make an educated decision. If this does not rectify the situation, you may want to partake in mediation. Mediation involves a neutral third party helping you and your ex work through the matters at hand. If this does not solve the problem, you may need the help of a New Jersey court. The court will make a decision in your child’s best decision. Be sure to speak with an experienced family law attorney regarding your options when it comes to vaccinating your child.
