A temporary restraining order (TRO) remains in effect until its either dismissed by the victim or by the court, or it is made final by the court.
At any time, a victim has the right to dismiss a temporary restraining order. However, if the order is not dismissed, the court will typically schedule a hearing within 10 days, as required under the Prevention of Domestic Violence Act.
During this hearing, the court will review all of the evidence presented and determine whether the temporary restraining order should be converted into a final restraining order or dismissed, based on the applicable statutory factors.
