Custody in the state of New Jersey is determined pursuant to statute, whereby the court would do an analysis as to the child’s best interest and would review the statutory factors. The statutory factors include the needs of the child, the employment responsibilities of the parents, where the parents will be living after the divorce, the safety and stability offered to the child. These are some of the factors under the statute.

But the court does an analysis and considers the child’s best interests and renders a decision as to residential custody. One parent would be considered the parent of primary residence, and the other parent would be considered the parent of alternate residence, or would have visitation with the child.
