How Long Will My Divorce Take to Resolve?

Besides concerns over the potential cost of a divorce, many of our Morris County divorce clients also wish to gain a clearer understanding of how long their divorce will take to resolve.

However, much like providing a cost estimate for your divorce, it can sometimes be difficult to gauge exactly how long the divorce process will last, as its duration is also dependent on many different factors.

With that being said, some of these factors can be evaluated during your free and confidential consultation and initial meetings with our Morristown divorce lawyers, meaning while we cannot give you an exact length of time to expect for your divorce to take, you will gain a clear understanding of which factors will play a role in your unique situation, and hopefully walk away with a rough, but accurate, estimate.

Options for Resolving a Divorce, Morristown Divorce Attorneys

Possibly the biggest determining factor when it comes to how long your divorce will take to resolve is that of which method is chosen in order to resolve the divorce.

In general, Alternative Dispute Resolution Methods such as mediation, collaboration, and arbitration have historically proven to be more time-efficient than more traditional methods of divorce. And while each of these methods has their own unique advantages and disadvantages (feel free to read our page on the topics to learn more), successfully resolving your divorce using an ADR method will critically require both parties to participate and support the process.

Obviously, divorcing couples will often be in disagreement about a great many different things, so if one spouse or the other is not willing to pursue an ADR method in order to resolve their divorce, you may instead need to rely on pre-trial negotiations, and, if all else fails, actual in-court litigation.

Litigation is definitely the most time-consuming, and expensive, way to resolve a divorce, but sadly may be necessary if one spouse or the other is unwilling to compromise in certain areas of their divorce settlement agreement, whether it be in terms of child custody, child support, alimony, marital asset division, or some combination thereof.

How Attitude and Approach Will Affect Your Divorce Timeline, Chatham Divorce Lawyers

Along the lines of what we discussed in the section above, the attitude and approach that each party will go a long way in determining how long a divorce will take to resolve.

For example, if each party is willing to communicate honestly and openly with one another, and work towards fair and reasonable agreements, then some form of ADR can most likely succeed for you, and help you more quickly, inexpensively, and amicably resolve your divorce.

However, if you have any reason to feel concerned over your spouse honestly and fully disclosing financial information, then ADR can be a financial risk, as there will be no way to compel this kind of information to be shared, and you will simply have to trust that your spouse is doing so.

As you can see, each party’s willingness to cooperate, conduct themselves in good faith, and compromise in different areas in order to more efficiently conclude the divorce process will go a long ways towards determining what kind of divorce process will need to be pursued, and how long that process will ultimately take to resolve.
